email before submitted

Hi

Newsletter is ticked in checkout and email is typed in. Then i submit without having filled out anything else, that is required for the form to be submitted. Obv it writes that i didnt fill out the required inputs, but im still getting this message, which i think is very wrong:

“We have sent you an email to confirm your newsletter subscription. Please confirm your subscription. Thank you.”
(and it is send)
