You can use any theme here: http://wordpress.org/themes/ – They’re all free to use and you can modify anything, there’s no naughty code in any of those themes.
isnt there a way to decode this andrew? because i really want to use this theme because of the layout

What do you mean by decode? Because you can read what the code is doing already.
at this moment its unreadable.. like in the pastebin

It’s not unreadable, it’s using standard PHP functions. You can even run the code in a PHP sandbox if you want. Get rid of the last unset bit and then echo out $m to see what that is: http://sandbox.onlinephpfunctions.com/

I’d secure your WordPress installation or contact your host. Then reinstall Decode from the Theme Directory.
