Almost every time I release a new version it includes a critical bugfix, so I urge you to download it anyway.

From my experience theme reviewing can take even up to two weeks. I know it’s annoying, especially when you updated a buggy theme and people keep downloading the version that contains bugs.
If you want to use an existing theme in your website and modify it, go ahead and do so, as long as you keep referring links to the original author.
I don’t really understand why did you upload it to here? You need a theme to be reviewed and approved only when you want to publish a new theme that you created for everybody to download, not when you want to use it for you site.Hope this clarifies things.

I’m the author of this theme and I made an effort to make it cross-browser and it works with IE6 and IE5.5.
Unfortunately I included in the zip the wrong version of the css file that fixes the problems with IE.I uploaded a fixed version of this theme more than a week ago but it still hasn’t been reviewed. I uploaded today even a newer version with another bug fix, so I hope they’ll review it ASAP so you could download the correct version.
