Both of the solution offered by these links are not working.
My server doesn’t not have suhosin installed and according to my host provider the logs are looking fine. They are convinced it’s a bug with Types plugin running along with PHP 5.3.16 (cli) (built: Sep 7 2012 12:10:42). Before the server move it was running fine on PHP 5.2.17 (cgi) (built: Mar 30 2011 23:35:05).

hi jozik,
Well no since deactivating Types remove all the categories I’m building the menu with there’s no way to tell for sure.
