Looking at the features of the new Checkout Block which is still in BETA and under active development as yet the Terms & Conditions checkbox is not integrated with the checkout block.
The second iteration of the checkout block is currently being tested internally and will bring some major changes to the way the checkout block can be configured. When released this will include a terms and conditions Block within the checkout block.
