Can you replicate the problem using the default 2012 theme with all plugins deactivated?

This just started happening. The site has been up for over 2 years and it never had this problem. No new plugins have been added. It was working. The site was hacked recently and I wonder if this had something to do with it?
I don’t have any other theme installed
ALL WordPress installs should have a copy of the current, unedited, default theme installed. Install the Twenty Twelve theme and then try the suggestion I posted above.

Something strange is happening to my site. I do not allow comments and have it set properly under Discussion to NOT ALLOW.
But comments are coming in? What is happening?
Also, when I UNcheck the post or page setting to allow comments. I save the page and when I come back to edit or view it. The box for comments is CHECKED. The theme company support says it is a wordpress function and not the theme’s fault
Anyone run across this problem? WHat is the solution? I cannot allow comments!!!
