500 internal error if checkbox not checked

    when commenting if the user does not check that they accept the privacy policy they get a 500 internal server error.

    Following as I have the same error. But there is no checkbox for the user to check and they still get this error.

    i did have to unhide the check box as my theme css had it hidden maybe double check with chrome web inspector that its not just hidden?
