Please try it through your own plugin. You’ll see what happens:

I’m not sure why you’re insisting the code is “bad”. It’s not my code, it’s the code from the WordPress developers. Nor is it “bad”: http://alistapart.com/article/css3-bling-in-the-real-world
Regardless of whether or not the code is “bad”, your plugin shouldn’t attempt to rip it out or correct it.

Indeed, your plugin should insert the CSS into the code, but the fact of the matter is that it does not, specifically when designing for different browsers (as I have done here).
The code is taken directly from the Twenty Eleven theme created by WordPress: http://wordpress.org/extend/themes/twentyeleven
