I just reread some of this thread, and reread the page you linked to. The person is crediting you for the work. Embrace open-source here. You simply modified a freely distributed .psd file for a freely distributed theme.
Take it as a compliment. Heck, spread some good will and holiday cheer, drive some traffic to your site, and share the header.
OR, create a totally unique header.

So, I will remove it as soon as Im back at home and use the standard graphics until I create my own.

I don't like to ask for re-using (is this the correct english word??). I see thats better to create my own pictures. I never work with this, but there always a first time.
