I am assuming that it might be a part of the agreement wordpress.com has with their premium theme partners who customize their themes especially for use on the wordpress.com site.
You may still be able to purchase the premium theme directly from the theme developer though.

You can install premium themes onto a WordPress.org site. In fact there are several options listed here: http://wordpress.org/extend/themes/commercial/

Is there a way to transfer premium themes purchased at wordpress.com to a wordpress.org site? I did what someone suggested. Searched for the author and found the web site. Themify.me
They not only have Elemin but others that look very cool.
