There will only be a regular “Place order” button when going through the express checkout flow: https://woocommerce.com/document/woocommerce-paypal-payments/#paypal-on-non-checkout-pages
So you could disable the buttons on the Checkout page and only provide the express checkout if you want only the regular WooCommerce “Place order” button.

By means of a php codes to display the original purchase button.

Yes, disabling the buttons on the Checkout page effectively disables the Checkout gateway. Users could then only initiate the PayPal payment process through the express buttons on the non-checkout pages. The express checkout process gets completed on your native WooCommerce Checkout page with a regular “Place order” button then.
For the regular PayPal gateway, it is not possible to display a normal “Place order” button as the smart buttons are replacing it by design. The majority of the functionality provided by the integration relies on these smart buttons.
If you are looking for a regular button with a redirect to PayPal, there may be other integrations that provide this kind of functionality. For example, the old PayPal Standard worked this way, but it is no longer supported and is therefore difficult to recommend.
But to address the origin of the question: It sounds like you assume PayPal Payments is not compliant with European regulations.
We do not provide legal advice, so please consult a lawyer if you want to learn more about it. But I contest your statement about the smart buttons not being compliant.
The buttons are provided by PayPal and come with different labeling options, including a “buy now” label.
The European Commission recently updated its guidance on the CRD [see 4.2.2. – Order confirmation button] and it suggests terms such as ‘buy now’, ‘pay now’ or ‘confirm purchase’ would convey the message required by the CRD.
