For existing users that are already subscribed, the checkbox at Checkout should be pre-checked when they get to the Checkout page, allowing them to check out without needing to check the checkbox again.
However, in cases where the user is not logged in or placing a “Guest” order, then the checkbox wouldn’t be pre-checked since it doesn’t know who they are until they enter their email. In that case, it’s possible the subscriber might leave the checkbox unchecked, which would result in them being unsubscribed from the list(s) that the Woo Checkout opt-in are linked to.
If you check out with an existing Subscriber while logged in, do you see the WooCommerce opt-in checkbox pre-checked when you reach the Checkout page?

First, no, the box is not pre-checked when I place an order while logged in and already subscribed.
Secondly, is it possible to deactivate automatic unsubscription when the subscriber places his order as a guest by forgetting to check the box.
I would like this checkbox to be used only for the subscription to the mailing list and that the description is only possible by the link present in the newsletter or via the customer's account management page, in order to avoid any risk of involuntary unsubscription.

That’s odd, it should appear pre-checked. Can you verify this while you perform a conflict test with only MailPoet and WooCommerce active?

This is not possible with the MailPoet plugin out of the box.
