using same sub-category names under different categories

i want to use the same sub-category names under different categories. For example, i have http://www.apparelgraphicsonline.com/products/ladies-apparel/t-shirts/ but I also have http://www.apparelgraphicsonline.com/products/t-shirts/

the ladies apparel t shirts sub category pulls from the upper level t-shirts category. I found some workarounds but they were for older versions of wordpress. Does anyone know how to get around this?
