I’m not sure what their policy is. When I first built the plugin I asked them for permission and they said it was okay to use their API. Over the years their policies have been a little vague — I’ve posted in Yahoo!’s “Exceptional Performance” group whenever I needed a clarification, and they’ve been pretty responsive.
I’d try there.

It’s strange as on http://developer.yahoo.com/yslow/smushit/faq.html#faq_api it says
“The API currently is not available for public use. We are working towards making this publicly accessible”
Makes it sound as if the API was never publicly available, and they are trying to release a public version…
It’s said that for ages. I’d try to get in touch with them…
