The load time is not affected by the TOC. The script that closes it si loaded in the page’s footer where it should be located so it is downloaded as one of the last assets to be loaded by WordPress.

A script is used to hide it and it always is displayed first and then hidden to accommodate the countless number of sites which have broken pages due to poor javascript. The broken pages I mean, when javascript encounters a fatal error all scripts loaded after the error will fail to run. From my experience supporting WordPress plugin most users are not even aware of their broken pages until something that should work, doesn’t. And if they are not looking, they simply will not know.

So, the TOC is shown by default in order to always have the TOC display so it will work perfectly on broken pages. Sorry, but I have no plans to change this behavior due to the large amount of support that I will have to endure due to broken pages. Heck, most users would simply blame the plugin for not working and move on not knowing the real reason for the trouble.

    Hope you understand.

ps. This also accommodates users who choose to run with javascript disabled.
