I’d suggest finding another theme – that vendor’s themes are not released under GPL – which is not consistent with WP policy or philosophy. They won’t be supported or welcome here at all.
You probably can’t remove the footer because they’ve booby-trapped the coding of the site – clear evidence that you should avoid that theme (or any others from that vendor).
OK, I understand that I cant remove footer, but Can I use without problem? They can access my site in the future? I must use this theme.
I have no idea what garbage is in that theme or what problems you might have with it. There are plenty of great, properly code, and GPL themes out there. Why go looking for trouble? As mentioned above, non-GPL themes are not supported or welcome here at all.

You don’t need a certain “type” of theme – you can make any theme into a restaurant theme. Find a theme that has the layout and basic functions you want and modify from there– both styles and plugins if you need them.
Or perhaps look for a commercial theme from these vendors –

But unfortunately, not finding a theme you like from the repository on this site, does not change the policy of WP or these forums.
