Hi, I suggest you close this topic and repost in the Themes and Templates category. Because this is a html/css issue. (you’ll also have a better chance of getting the right help there.)
Please do not do that. Duplicate topics are usually deleted on sight unless posters have been advised otherwise. Where did you download this theme from?
Apologies esmi, If a post is posted in the wrong category what can I advise next time?

If the topic references a specific theme, then point the OP to the theme’s dedicated forum via it’s page in http://wordpress.org/themes/. If it’s something like a support request posted in Your WordPress, I’d suggest asking a mod to move the topic via the modlook
tag.

Have you edited the theme in any way?

Yes I have edited the css.
That theme is quite outdated – which may also be a problem:

Yes I’ve known about this issue for quite some time but I know its going to be a big project to switch everything to a new theme. I may use a new theme sometime after im satisfied with what I got now.
Yes, duplicate threads are deleted – it’s now been moved.

Thanks!! For the time being would conditional css seem like the way to go? Also in the validator im getting
Line 2, Column 13: there is no attribute “XMLNS”
<html xmlns=”http://www.w3.org/1999/xhtml” lang=”en-US”> I cant seem to figure out how to fix this and I think its cause alot of the other errors or warnings. Maybe the doctype is wrong?
<!DOCTYPE HTML PUBLIC "-//W3C//DTD HTML 4.01 Frameset//EN" "http://www.w3.org/TR/html4/frameset.dtd">
is definitely wrong!

Do you suggest <!DOCTYPE html PUBLIC “-//W3C//DTD XHTML 1.0 Transitional//EN” “http://www.w3.org/TR/xhtml1/DTD/xhtml1-transitional.dtd”> ?
<!DOCTYPE html PUBLIC "-//W3C//DTD XHTML 1.0 Transitional//EN" "http://www.w3.org/TR/xhtml1/DTD/xhtml1-transitional.dtd">
is the DOCTYPE used in the original theme.

After changing the doctype and revalidating the error goes away. However the issue with the line not being in the correct spot in IE remains.
