For example, if they have access to the emails provided by visitors of Website.com, wouldn't that mean Website.com's privacy policy would need to mention the involvement of Automattic when it comes to handling their emails in order to comply with California Online Privacy Protection Act, or would that be covered in the whole "we only share your information with trusted third parties who agree to keep your information confidential?"

All your public posts (non password-protected, non private) are indeed synchronized with WordPress.com servers so we can send out subscription emails and publish links to these posts on your Social Network profiles (if you use Publicize), among other things.

Your subscribers' email addresses are also stored on WordPress.com servers, since the emails are sent from there. That's why Automattic's Privacy Policy applies to Jetpack too. You might want to mention this Privacy Policy in your terms of service.

I hope this clarifies things a bit.

Hi there, I'm sorry for digging up such an old thread, but is there a way for email subscribers to get an email when password-protected posts are published? Even if it asks to visit the page and insert the password there.
    Thanks

I'm afraid that's not possible. These posts are not synchronized with WordPress.com and we consequently can't send any emails about it from our servers.
