The data is stored where YOU have the website hosted. π
Anyway I don’t know if you have special local law, but the GDPR does NOT imposes personal data to be in EU but only to verify that, is not in EU, there is a clear agreement with the not EU country compatible with GDPR and that you can have a DPA in place with that not EU service so the GDPR requirements are respected.

In case of GDPR you need to conform all of newsletter receives, not only unconfirmed of imported addresses.
What we need is following:
A shortcode (link) to profile and the possibility to re-confirm users. User that take no reconfirm, stay unconfirmed. I’m not sure if the function already exists, but this is my idea for GDPR readyness π
Sorry, try to explain me better with a use case. Do you want to ask to your registered contacts to confirm they still want to receive your newsletters?

So, follow our guide in the blog http://www.thenewsletterplugin.com. When users confirm the subscription they should have a log in their panel stating then the storage of the confirm status at specific time. This is the log that demonstrate they changed their status.
