 * i think there’s a little bug in this function because when you decide to hide
   empty categories the “sort by” doesn’t function correctly. So i found a way to
   correct this…
    you have to search for : GROUP BY category_id (arround the line
   299) and replace it by : GROUP BY cat_$sort_column
 * it’s works for me 🙂
