Avoid Index if Content empty

Hello,
I have customized sm_addurl to ignore certain sitemap entries. In doing so, there are now empty sitemaps referenced by the index. Is there a way to remove these indexes if the sitemaps are empty?
It looks like the index is created before the files are created and ignores my customizations to the files. Therefore there are errors in each of those files.
Is there something else I can hook that will allow me to create the content before adding the index and if there is 0 content not add the index?
