This issue is because the browscap.ini file that the plugin depends on doesn’t have support for newer versions of Android yet. This issue is on our todo list, thanks for reporting it.

Just opened a site using is_mobile && !is_ipad on my Samsung Note and find the mobile navigation appearing.
@bravenm – you should open a a new thread, this one is closed. Also you will need to provide more information about your issue, this plugin detects the user’s device/browser but it doesn’t do anything as far as changing the way a site behaves by itself, you need to code that.
