sometime i put all my sidebar tags outside the endif (i just do ok!) and the only way to prevent the sidebar from defaulting to the content/tags inside the ednif is to add an empty text widget, but often it inserts a tag, so why not a widget that does NOTHING?

I think it'd be better to fix your need to put your sidebar tags outside of the conditional. That's the only reason your theme is breaking. Why create a (somewhat) useless widget that does nothing just to fix a condition you admit is bad behavior?
If you put your sidebar tags outside of the conditional because you are having difficulty modifying the theme to get it to do what you want, let me know as I can probably fix it the proper way without the need for an 'empty' widget.
