It’s not associated with WordPress.org if that’s what you mean by not being legitimate. So it is not legitimate.
It’s actually infringing on WordPress’ trademark by putting “WordPress” in the domain name http://wordpressfoundation.org/trademark-policy/ .

Careful here, they state they will not hold responsibility (i.e won’t support) issues with themes that they distribute when those themes update or WordPress updates.
See “Do You Offer Support With Your Service” under FAQ.
WordPress.org forums do not actually support any theme that is not distributed on WordPress.org, meaning you might be left with no support whatsoever if you experience issues on updates.
It’s also a bit crazy how they limit you to how many pages you can make. This is not a limit that WordPress (the actual software) imposes.
Note
I try not to attack theme and plugin authors who sell their creations, because that’s absolutely fine. I just don’t like organisations that just redistribute themes and plugins and then charge extra (the website builder doesn’t actually make any themes).

Unfortunately, we’ve seen a few other reports about that site – see:

But, like Andrew said, they aren’t affiliated with WordPress, so we really can’t help you.
I tried to get them to refund my money, and they dont respond to emails and have no phone number anywhere. Thanks the information.
I have had success in getting similar refunds after having used PayPal, so you might try talking with PayPal if you had paid that way.
