Possibly Malicious Theme from ThemeForest – What Do You Think?

Hello, I’d like to have your opinion on a theme.

I bought a premium theme “James” from ThemeForest. The theme apparently works pretty well with a single WP install, but I have a multisite and I ran across various problems. I checked the theme against Theme Check and I got a number of errors which look pretty bad and malicious to me:

I checked ThemeForest’s FAQ for theme authors and there’s this:

Q: Are files reviewed or will you accept anything?
A: Each file goes through a rigorous reviewing process to make sure the quality is top notch. That’s why so many buyers choose our marketplaces over those that accept lower quality files.

Does it mean that I’m crazy and the theme is fine or they don’t check that well and I can demand my money back?
