I'm seeing the API terms of service error, too. I don't have any other google api requests being made.

According to Google API Access Notice, it seems to be possible to continue using the API with a limited number of translations if you have an API key, which you can get for free. If the plugin is made configurable with an API key for each install, it is probably possible to continue the Google translation.
Bing has a similar API which is still free. I see it is used in other plugins.

Google Official :
Google Translate API v2 is now available as a paid service only, and the number of requests your application can make per day is limited. As of December 1, 2011, Google Translate API v1 is no longer available; it was officially deprecated on May 26, 2011.

Mayby Google Website Translator gadget http://translate.google.com/translate_tools will be useful?
Has been solve with version 1.99.17 and enables now Google Translate V2 API and Microsoft Translate Service.
