managed to kill my site today by changing the sites theme function file.
After downloading a backup generated by this plugin the backup function.php was exactly the same as the one i had changed (with the errors)
downloaded a backup 7 days old and again the function.php file was as the new one i edited an hour ago.

I'm not sure I understand your issue exactly.
Are you saying that old backupwordpress backups contain a file that you only just edited? That would sound impossible.

yeah thats exactally what im saying!
as if the backup of the files isn't actally creating a backup but just creats the zip download when you click the download link....
where i store my backup on the server and download if and when i need them

there has been updates since this post so im not sure if this issue has been sorted.

The backup definitely doesn't create the zip at the point you click download, there must be some other explanation for what is happening.
Can you reproduce the issue separately to that incident?
