I am modifying the Twenty Ten theme by creating a child of it.
I want to do this properly so adding licensing info.
Without getting into flame wars am I okay to put my modification under
License : GNU General Public License (GPL) version 3: as the original doesn't seem to specify what it is using?

GPL 2 might be better.

I am sorry I should have phrased it better, does the importing of twentyten mean I should use what they are using? I am not really concerned about which license but want to honour the spirit in which the original was created.
But as you say I'll mark it as GPL 2!
