    hi,
I found a site with a nice theme,
and I want to modify it. (not use it as it is)

the css says it is a custome theme (so I can't download it from anywhere)

    how can I "grab" it?

    I tried ftp, but didn't worked :(

    any idea?
    It would really help me.

    thanks in advance
    cheers!

You don't "grab" it if it is a custom theme. It would be stealing.

but I want to play with it...
    see how is it made.

I can see the CSS, but I would like to test some variations.

I tried to contact the designer,
    but no answer.

Then it means he doesn't want you to play with it. Honestly, if I made a custom theme for a client of mine and he paid for this exclusive design, I wouldn't let you either to mess with it. The client paid for the exclusive use, which means you can not "play" with it. It is that simple. Move on...

No, there does not have to be a way.

You cannot "grab" a theme like that. You can try to recreate it, but you cannot just "grab" it off somebody's site without them giving you a download link for it.
