first- when i try to create a static front page "home" isnt in the drop down list.
second- when i put my blog page for the "post" page, it makes my home page appear on the home and blog tab.

First you have to create a page called Home. Then it will be in the drop-down list.
thanks for the quick reply but a home page is already created for me but listed as "custom" thus i can't find it in the drop down list. When i put "blog" in the post section it changes my blog tab to what appears on my home page.

Does Custom show up in the list?
As this is a commercial theme and/or its template files are not publically accessible, you need to seek support from the theme vendors.

custom isnt the name of the page. In the menu HOME is at the top but instead of saying "page" like the others, it says "custom". At that very same home page in the menu with the "custom" isnt listed as a home page in the drop down menu to make it my static page.

Sounds like they may be using a custom page type as part of the theme. Can you just change the publish status on that one to Draft and create a new page called Home with the default page type? As Esmi said, you may be better off contacting the theme developers.
