   My programmer has changed the colour scheme of the banner on the Big City theme, this was not done inside wordpress but with other software.

   Is this copyright infringement? because he has basically copied the banner, changed the colour scheme and added a logo and passed it on to me as a banner I can user on my facebook page.

   Since Big City is a premium theme, the question of copyright would depend on the licensing or terms/conditions of the seller of that theme. You'll have to look there or ask them.
