Hi kitcorsa,
You might double check that Toolbar display option is enabled in your Profile settings menu.

yeah show tool bar when editing site is ticked in my profile and no tool bar?
Will i needto update something in my template? i noticed the stadard templates also needed an update as well as the site, is there a change to the toolbar code?
THe standard thing to try would be switching to 2011 theme, and testing
Then deactivating all plugins and testing
Some plugin conflicts always pop their head up on a wordpress upgrade
It's likely it's your theme. Try switching to TwentyEleven to see if it shows up.

If it is my theme whay would it be?
i don't want to change my theme as I created the theme my self and has all my banding
kitcorsa - TEST by switching themes.
If it's your theme, then you did something wrong (and since it's custom, it's really hard for us to guess past 'You did something that messes with the admin bar'). Search your functions.php for ANYTHING to do with admin-bar, but if you're unwilling to try a different theme, it's really hard for us to help.
