   one works, one doesn't. .htaccess rewrite lined for comments ar teh same, except the wp directory...any ideas?

   I have tried recreating the permalink structure in both installs and it is still the same error...

   Delete that trackback and you should be fine. That's happened a couple of times to me too, but seems to only happen when you trackback your own blog.

   so the comments feed cannot show trackbacks? will i need to delete any future trackbacks or disable trackbacks to prevent this

   No, the problem only seems to occur when you trackback your own blog. All other trackbacks are fine.
